By using any Additional Product Offering, (1) you confirm that you have reviewed and agree to be bound by these Product Terms on behalf of yourself and/or the applicable entity for whom you use NextShopper, and (2) you agree that these terms are incorporated by reference into either NextShopper’s Terms of Service or any related agreement between you and NextShopper (“Agreement”).
For example, if you choose to use NextShopper’s SEO services and no other Additional Product Offering, you agree to be bound by the terms and conditions specific to SEO within these Product Terms. If you do not agree to these terms, you may not use (and must discontinue any use of) the applicable Additional Product Offering.
2.1 Integrations, Offerings, and Usage
In your sole discretion, you may choose to integrate or enable certain third-party services, platforms, applications, and add-ons with your services, such as Shopify for store build-ups or specific analytics tools for SEO (collectively, “Third-Party Services”). Any Third-Party Services you use are subject to their respective providers’ terms and conditions, not to those of NextShopper. NextShopper does not control and makes no representations or warranties regarding any Third-Party Services.2.2 Responsibilities and Availability
You acknowledge that NextShopper is not responsible for Third-Party Services’ support, maintenance, or technical assistance, and may suspend, disable, or remove Third-Party Service access at any time.
For payments, you must have an account with a third-party payment processor (e.g., Stripe). You agree that NextShopper is not a party to transactions with your end-users and is not liable for issues related to payment processing, refunds, or chargebacks.
NextShopper provides tailored web and app development services designed to meet specific client needs. These services may include website redesigns, development of new sites or apps, and integration of features to enhance functionality. Clients are responsible for providing accurate project details and timely feedback. NextShopper retains ownership of any custom code until full payment is received.
NextShopper’s SEO services are designed to improve the online visibility and search ranking of your website. These services may include on-page optimization, keyword research, backlink creation, and content enhancements. You are responsible for providing relevant information and access to your website’s backend to facilitate these improvements. NextShopper does not guarantee specific ranking outcomes, as SEO results depend on numerous external factors.
NextShopper offers updates to outdated websites, implementing necessary changes to align your site with current technologies, visual standards, and security requirements. These upgrades may include migrating older CMS versions to newer ones, updating design elements, and improving compatibility across devices and browsers. You agree to provide any access needed to perform these updates and to review all changes before publication.
Our Web Optimization services are designed to enhance website performance, speed, and user experience. Services may include load time reduction, responsive design adjustments, and improvements in site functionality. NextShopper will assess and implement optimization strategies tailored to your site’s needs.
In the event of any conflict between these Product Terms and the general Agreement, the applicable terms and conditions within these Product Terms shall govern with respect to the conflict. All other terms and conditions of the Agreement shall remain in full force and effect.
NextShopper reserves the right to update these Product Terms. You are responsible for reviewing any changes regularly to stay informed of applicable terms.
