Trademark Usage Policy

1. Introduction

NextShopper encourages businesses built on our services and aims to foster fair commercial use of our brand. This Trademark Usage Policy (“Policy”) sets guidelines for the use of NextShopper trademarks (the “NextShopper Marks”). These guidelines are meant to help individuals and businesses use our marks respectfully and transparently. Undefined capitalized terms in this Policy have the meanings assigned in our Terms of Service or related agreements.

2. Intent of this Policy

NextShopper owns and oversees the trademarks for the NextShopper name, logos, and other brand assets (collectively, the “NextShopper Marks”). This Policy is designed to:

  • Provide guidelines for using the NextShopper Marks;
  • Clarify how businesses and projects related to NextShopper can or cannot use these marks; and
  • Prevent any use of the NextShopper Marks that could mislead, confuse, or unfairly profit from users seeking official NextShopper resources.

Permission is required for any use of the NextShopper Marks not specifically permitted under this Policy. NextShopper reserves the right to revoke usage rights if your use of the marks violates this Policy, our Terms of Service, or any other relevant agreements.

3. Prohibited Uses of the NextShopper Marks

Without explicit permission, you may not:

  • Register any NextShopper Marks (or similar names) as part of a domain name;
  • Combine any NextShopper Marks with your company’s name, products, or logos, or incorporate them into your own logo;
  • Use a logo, company name, or domain name that is confusingly similar to the NextShopper Marks;
  • Use terms like “NextShopper Partner,” “NextShopper Certified,” or similar phrases;
  • Alter the color or modify the NextShopper logos, add words around them, or overlap them with other images; or
  • Use outdated versions of the NextShopper Marks.

4. Permitted Uses of the NextShopper Marks

You may use the NextShopper Marks in a referential way to describe your services (but not in stylized form), provided it doesn’t imply endorsement or affiliation with NextShopper. The use of any NextShopper Mark must be secondary to your own business name or brand.

For example, a consulting business named “Prime Web Services” may describe itself as “Prime Web Services, offering NextShopper consulting.” However, it cannot use the name “The NextShopper Consulting Company.”

Similarly, a template provider named “Innovative Templates” may describe itself as “Innovative Templates, creators of NextShopper templates,” but cannot call itself “The NextShopper Template Company.”

All usage must adhere to NextShopper’s Brand Usage Guidelines.

5. Advertising Rules and Restrictions

  • Keyword Targeting: Do not use the NextShopper Marks in keyword targeting for ads (e.g., AdWords or similar).
  • Ad Content: You may use NextShopper Marks in ad text only to refer to your services and in a way that doesn’t imply endorsement. For instance, you may run ads that say, “XYZ Design, specializing in NextShopper sites,” but not “XYZ, the NextShopper Experts.”

For presentations, webinars, or materials featuring the NextShopper Marks, include disclaimers such as: “This webinar is independent of NextShopper and is not authorized, endorsed, or affiliated with NextShopper.”

6. Requesting Permission to Use the NextShopper Marks

If you wish to use the NextShopper Marks in a way not outlined in this Policy, please contact us at [email protected] for permission. If in doubt, reach out for clarification.

7. Violations of this Policy

NextShopper may, at its discretion, suspend or terminate your access to the platform without notice if you violate this Policy. Continued violations may result in further restrictions.
